Eviction

How much notice does a landlord have to give to evict in California?

For non-payment of rent, a 3-day notice to pay or quit (excluding weekends and holidays). To end a month-to-month tenancy, 30 days if you've lived there under a year and 60 days if a year or more. Covered tenants of 12+ months can only be removed for 'just cause' under AB 1482.

A notice is not an eviction. If you don't move or pay, the landlord must file an unlawful-detainer case and win before you can be removed; only a sheriff can carry out the eviction.
